In this Agreement & Disclaimer ("Agreement") "you" and "your" refer to each customer or workshop attendee, "we", us" and "our" refer to Business Excellence Centers, “Do It Now! “ or its contractors, agents, employees, officers and directors ("Company") and "Services" refers to the training services, supplies, and materials provided by us.

THIS WORKSHOP IS PROVIDED AS-IS WITH NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, MARKETABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. YOU ASSUME COMPLETE RESPONSIBILITY AND RISK FOR USE OF THIS WORKSHOP AND ANY AND ALL SUBSEQUENT RELATED BUSINESS SERVICES PROVIDED BY YOU.
COMPANY, ITS AGENTS, REPRESENTATIVES AND EMPLOYEES ARE NEITHER RESPONSIBLE NOR LIABILE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO THIS WORKSHOP, YOUR BUSINESS RELATED SERVICES AND/OR CONTENT OR INFORMATION CONTAINED WITHIN THE WORKSHOP.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE WORKSHOP OR ITS SERVICES IS TO STOP USING THE WORKSHOP MATERIAL AND/OR THOSE SERVICES. COMPANY SHALL NOT BE LIABLE TO YOU OR YOUR BUSINESS FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OR LOST OR IMPUTED PROFITS OR ROYALTIES ARISING OUT OF THIS AGREEMENT OR ANY GOODS OR SERVICES PROVIDED, WHETHER FOR BREACH OF WARRANTY OR ANY OBLIGATION ARISING THEREFROM OR OTHERWISE, WHETHER LIABILITY IS ASSERTED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT PRODUCT LIABILITY) AND IRRESPECTIVE OF WHETHER YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH LOSS OR DAMAGE.
COMPANY FORMS "PARTNERSHIPS" OR ALLIANCES WITH SOME VENDORS FROM TIME TO TIME IN ORDER TO FACILITATE THE PROVISION OF THESE PRODUCTS AND SERVICES TO YOU. HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT AT NO TIME IS COMPANY MAKING ANY REPRESENTATION OR WARRANTY REGARDING ANY THIRD PARTY’S PRODUCTS OR SERVICES, NOR WILL COMPANY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CLAIMS ARISING FROM OR IN CONNECTION WITH SUCH THIRD PARTY PRODUCTS AND SERVICES. YOU HEREBY DISCLAIM AND WAIVE ANY RIGHTS AND CLAIMS YOU MAY HAVE AGAINST COMPANY WITH RESPECT TO THIRD PARTY PRODUCTS AND SERVICES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We make no warranty regarding any goods or services purchased or obtained or any transactions entered into with COMPANY. No advice or information, whether oral or written, obtained by you from COMPANY shall create any warranty not expressly made herein. COMPANY, at its sole discretion, may choose to change the terms, conditions and operation of this workshop series at anytime. By using this service, the user waives any rights or claims it may have against COMPANY.
The content available through the WORKSHOP is the sole property of COMPANY and is protected by copyright, trademark and other intellectual property laws. Except as otherwise explicitly agreed in writing, COMPANY-owned content received through the WORKSHOP may be downloaded, displayed, reformatted and printed for your personal, non-commercial use only. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through the WORKSHOP to anyone, including but not limited to others in the same company or organization without COMPANY’S express prior written consent.
YOU OWN YOUR URL, WEBSITE FOLDERS AND CONTENT WITHIN, AND ANY AND ALL INTELLECTUAL PROPERTIY WRITES. COMPANY DOES NOT OWN ANY MATERIAL CREATED FOR YOUR BUSINESS ENTITY.
THE WORKSHOPS, HANDOUTS, MATERIALS, OPINIONS, AND/OR STATEMENTS ARE NOT A SUBSTITUTE FOR LEGAL COUNSEL! ANY LISTS OF LEGAL COUNSEL OR PROFESSIONAL CONTACTS ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT IMPLY AN ENDORSEMENT BY COMPANY.
The materials posted on any of COMPANY’s websites are provided for public informational purposes only.
DISSATISFACTION
If for any reason you are dissatisfied with the services of COMPANY after receipt of any services or electronic digital goods, COMPANY will work with you to try and resolve the issue. You are under no obligation to continue with COMPANY, and can cancel your membership (if any) at any time.
REFUNDS
Under no circumstance does COMPANY provide refunds to dissatisfied customers. All services are accurately represented and explained within the COMPANY WORKSHOPS and website. For this reason, refund requests shall be ignored. It is the sole responsibility of YOU to read and understand what services COMPANY offers prior to signing up.
TERMINATION
It is the responsibility of YOU to cancel any recurring subscriptions if you wish to discontinue your service with the COMPANY. Cancellation may be done by logging into your assigned account(s) and canceling the subscription. Please notify COMPANY so follow up and/or concurrent billing does not occur.
GOVERNING LAW
By attending this WORKSHOP, you submit to the exclusive jurisdiction of Atlantic County, NJ, and you waive any jurisdictional venue, or inconvenient forum objections to such courts. You agree that, if an agent for you (i.e., an Internet Service Provider, employee, etc.) purchased our Services on your behalf, you are nonetheless bound as a principal by all terms and conditions herein.
ADDITIONAL DISCLAIMER NOTICE
Do not invest in this training if you think it will automatically make you money just because you attended a Business Excellence Center or “Do It Now!” workshop. You have to work hard to succeed in anything (especially business) and we will make no excuses for that. The results we’ve had here and in other areas of our lives aren’t typical and didn’t come right away either! Your results could and probably will vary. In the end, you may not make any money at all.
